Throughout this document, the terms “we”, “us” and “our” refer to Liberty Electro LLC; The terms “Liberty Electro” and “site” refer to libertyelectro.com. Liberty Electro LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”, “agreement”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you do not agree to these Terms, including the Liberty Electro Privacy Policy and Copyright Policy, please do not use this website.

The site is controlled, operated, and administered by Liberty Electro LLC from its offices within the United States of America. Liberty Electro makes no claim that the content of libertyelectro.com is appropriate or available for use at other locations outside of the United States, and access to them from territories where such content is illegal is prohibited. If you access the site from a location outside of the United States, you are responsible for compliance with all laws of that country.

These Terms apply to all users of libertyelectro.com, including those who contribute User Submissions (as defined below). These Terms apply to all content and works of authorship, visual interfaces, interactive features, information, graphics, design, compilations, photographs, computer codes, API’s, products, software, photographs, services, audio/visual elements, creations, motion pictures, musical compositions, sound recordings, proprietary materials, intellectual property, and all other elements of and materials incorporated in, appearing on, or published on the Websites, trademarks, trade secrets, patents, other intellectual property and/or proprietary material, and all rights therein, of any kind and nature, in any and all media now known or hereafter devised (collectively, “Material”).

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current site shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

1.1 User Age Requirements

By agreeing to these Terms of Service, you represent that you are at least 18 years of age or the age of majority in your state or province of residence (whichever is greater); If you are under 18 years of age, please do not use this website.

We reserve the right to refuse service to anyone for any reason at any time.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

1.2 Membership Accounts

In order to access the features of the site, you must sign up for a membership account. There are four membership types available, Subscriber, Contributor, Benefactor, and Diehard. Subscriber memberships are FREE. Subscribers can access Subscriber level content and can comment on stories. They are eligible for the Subscriber Published Story Award (SPSA) for submitted materials. Subscribers cannot access certain content and are not eligible for the Contributor Published Story Award (CPSA) for submitted materials. Contributor memberships cost $2.99 per month. Contributors can access all Subscriber and Contributor level content, comment on stories, and are eligible for the CPSA for submitted materials. Benefactor memberships are yearly memberships bill annual and cost $100 per year. Benefactors can access all Subscriber, Contributor, and Benefactor level content, comment, and are eligible for the CPSA for submitted materials. Benefactors also get special consideration when submitting stories. Special consideration means that when a Benefactor submits a story, it will be read before that of any Contributor and may therefore be selected for publication sooner. Diehard memberships are a yearly membership for an annual payment of $500. Diehards can access all Subscriber, Contributor, Benefactor, and Diehard level content, comment, and are eligible for the CPSA for submitted materials. Diehards also get special consideration when submitting stories. Special consideration means that when a Diehard submits a story, it will be read before that of any Contributor and may therefore be selected for publication sooner. Membership subscriptions do not expire. Billing will continue until the membership is cancelled by the membership account owner (you). MEMBERSHIP FEES ARE NOT ELIGIBLE FOR REFUNDS. Meaning, membership fees will never be refunded for any reason. This included banned members. Members banned for violation of these terms, the privacy policy, the copyright policy, or the discourse notice, will not have their any fees refunded.

You may never use another’s account without permission. When creating your account, you must provide accurate and complete information. You agree that you will not solicit, collect or use the login credentials of other Liberty Electro users. Liberty Electro LLC prohibits the creation of, and you agree that you will not create, an account for anyone other than yourself. You also represent that all information you provide or provided to us upon registration and at all other times will be true, accurate, current, and complete. You agree to update your information as necessary to maintain its truth and accuracy.

You are solely responsible for the activity that occurs on your account, and must keep your account password secure and protected from unauthorized use. You must notify Liberty Electro immediately of any breach of security or unauthorized use of your account. Although we will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Liberty Electro LLC or others due to such unauthorized use.

We will not be responsible for any unauthorized access to, or alteration of, your transmissions of data or any material, information, or data sent to or received from your account, regardless of whether the data is actually received by Liberty Electro.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – CONTRIBUTOR SUBMISSIONS AND CONDUCT

2.1 – Contributor Submissions

Members may submit picture, image, or video content (“User Pictures”) and textual content, including but not limited to, comments and stories (“User Stories”) to Liberty Electro, via upload or submission functions on the website or third-party websites used by Liberty Electro LLC, via email to stories@libertyelectro.com, or via Mobile Services. User Pictures, User Comments, and all Material and IP Rights therein are collectively referred to as “User Submissions.” You understand that whether or not such User Submissions are published, Liberty Electro does not guarantee, and disclaims, any confidentiality with respect to any User Submissions. You grant Liberty Electro LLC the right to edit and/or modify any User Submissions. We reserve the right to not use the User Submissions at all and/or to use as much or as little of the User Submissions as deemed appropriate. The website is supported by advertising revenue and may display advertisements and promotions, and you hereby agree that Liberty Electro LLC may place any and all advertising and promotions on the site or on, about, around, incorporated into, or in conjunction with your User Submissions. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you. You must be 18 years old or the age of majority in your jurisdiction of residence (whichever is greater) to become a member and submit User Submissions.

2.2 – Contributor Responsibility

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions and all Material used, contained, displayed, featured, incorporated, or appearing therein or related thereto, you affirm represent, and warrant that:

  1. you own or have all the necessary licenses, rights, consents, and permissions, including without limitation, all IP Rights, to use and publish your User Submissions and to license your User Submissions to Liberty Electro LLC;
  2. you have secured all rights, licenses, and permissions to use and to license to Liberty Electro LLC, any and all works Material owned by any third party, used or appearing in or in connection with your User Submissions;
  3. you own or have all the necessary licenses, rights, consents, and permissions, including without limitation, all rights relating to the name, image, likeness, right of privacy, and right of publicity whether common law or statutory) of any person appearing in any User Submission (collectively, “Personal Rights”), to use and publish your User Submissions and to license your User Submissions to Liberty Electro LLC — and further that any such person is at least 18 years old or the age of majority in the jurisdiction in which that person resides (whichever is greater) or, if that person is younger than the greater of 18 years or the age of majority, you have received such permission from that person’s parent or legal guardian; and
  4. your User Submission does not infringe and will not infringe on the copyright, trademark, trade secret, rights of privacy or publicity, or other intellectual property or personal rights of any person or entity.

In addition, you may not submit any video that is unlawful, harmful, abusive, or harassing, constitutes inherently dangerous activities, or threatens your safety or the safety of any other person. Further, you authorize and license to Liberty Electro LLC to use all IP Rights and all Personal Rights in and to any and all User Submissions to enable publication and use of the User Submissions in the manner contemplated by the site and these Terms.

2.3 Licensing

For clarity, you retain all of your ownership or licensed rights in your User Submissions. However, by submitting User Submissions to Liberty Electro LLC, being selected for publishing, and then being compensated with a one-time payment of the CPSA or SPSA amount defined at the time of publishing, you hereby agree as follows:

  1. you grant to Liberty Electro LLC a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, license to publish, display, telecast, rerun, User Submissions in any media formats now known or hereafter devised and through any media channels, in connection with: the site; you grant each user of the site a non-exclusive license to access, view, read, User Submissions through the functionality of the site and under these Terms;
  2. you waive any claims you may have based on the usage of User Submissions in any media formats now known or hereafter devised and through any media channels, in connection with: the site; including but not limited to claims of infringement, invasion, misappropriation, or violation of IP Rights or Personal Rights; You understand and agree that Liberty Electro LLC may retain, but not display or distribute server copies of User Submissions that have been removed or deleted.

The above licenses granted by you terminate within a reasonable time after your User Submissions is removed or deleted from the site, if so removed or deleted.

2.4 Submitted Content Restrictions

You agree not to post, email, or otherwise make available any User Submissions that:

  1. are unlawful, harmful, pornographic, obscene, threatening, abusive, harassing, defamatory, libelous, invasive of another’s privacy, or is harmful to minors in any way;
  2. harass, degrade, intimidate or are hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
  3. impersonate any person or entity, including, but not limited to, a Liberty Electro LLC employee, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  4. include personal or identifying information about another person without that person’s explicit consent;
  5. infringe on or violate any IP Rights, Personal Rights, or other proprietary rights of any party;
  6. you do not have a right to make available under any law, or under contractual or fiduciary relationships;
  7. constitute or contain any form of advertising or solicitation, “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or unsolicited commercial advertisement;
  8. contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the site or any computer software, hardware or telecommunications equipment;
  9. disrupt the normal flow of dialogue with an excessive amount of User Submissions (flooding attack) to the site, or that otherwise negatively affects other users’ ability to use the site;
  10. employ misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of User Submissions transmitted through the site; or
  11. violate any applicable civil or criminal laws or regulations, or promote any illegal activity.

2.5 Third Party Rights

In connection with User Submissions, you further agree you will not submit any User Submission that is subject to a third party’s copyright, protected by third party’s trade secret or otherwise subject to third party proprietary rights, including IP Rights and Personal Rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Liberty Electro LLC, all of the licenses granted herein.

2.6 Our Data Practices

You acknowledge that Liberty Electro LLC may establish general practices and limits concerning use of the site, including without limitation the maximum period of time that User Submissions or other data or materials will be retained by the site and the maximum storage space that will be allotted on our servers on your behalf. You agree Liberty Electro LLC and has no responsibility or liability for the deletion or failure to store any User Submissions or other data or materials maintained or transmitted by the site. Liberty Electro LLC reserves the right to delete any User Submissions for any reason, without prior notice, including, without limitation, to provide additional capacity on the site. Deleted User Submissions may be stored by Liberty Electro LLC in order to comply with certain legal obligations and are not retrievable without a valid court order. Consequently, Liberty Electro encourages you to maintain your own backup of your User Submissions. You also acknowledge Liberty Electro reserves the right to terminate accounts that are inactive for an extended period of time.

2.7 Liberty Electro’s Modification or Removal of User Submissions

Liberty Electro LLC does not control User Submissions posted by users or otherwise made available by other persons and does not have any obligation to monitor such User Submissions. If at any time, Liberty Electro LLC chooses, in its sole discretion, to monitor the User Submissions, Liberty Electro LLC nonetheless assumes no responsibility for the User Submissions, no obligation to modify or remove any inappropriate User Submissions, and no responsibility for the conduct of the user submitting any such User Submissions. Liberty Electro LLC does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Liberty Electro LLC, expressly disclaims any and all liability in connection with User Submissions. Liberty Electro LLC does not permit copyright-infringing activities on its website, and Liberty Electro LLC will remove all Content and User Submissions if properly notified that such User Submission infringes on another’s copyright pursuant to Liberty Electro LLC’s Copyright Policy (see the Copyright Policy). Liberty Electro LLC reserves the right to remove User Submissions without notice.

2.8 No Alteration of Website

You agree not to alter or modify any part of the site or to obtain or attempt to access or otherwise obtain any materials or information through hacking, password mining or any other means not intentionally made available or provided through the site. You must not interfere or disrupt the site, servers, or networks connected to the site, including by transmitting any worms, viruses, spyware, malware or any other code of a disruptive nature. You may not inject content, code or otherwise alter or interfere with the way in which any Liberty Electro page is rendered or displayed in a user’s browser or device. You agree not to use or launch any automated system — including, without limitation: “robots,” “spiders,” or “offline readers” — that accesses the site in a manner that sends more request messages to the Liberty Electro LLC servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser. You agree not to collect or harvest any personally identifiable information, including account names, from the site, nor to use any communication systems provided by the site (e.g., comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the site with respect to their User Submissions. In your use of the site, you will comply with all applicable laws, statutes and regulations.

2.9 Feedback

If you provide feedback, questions, comments, suggestions, ideas, or other information to us regarding the sites, Content, or User Submissions (collectively, “Feedback”), you acknowledge that the Feedback is non-confidential and authorize use of that Feedback without restriction and without acknowledgment, payment or other compensation to you. Accordingly, you hereby grant to us perpetual and irrevocable license to use the Feedback for any purpose, commercial or otherwise.

SECTION 3 – USE Of MATERIAL

Your right to use this site, as well as any Material or other content appearing on it, is subject to your compliance with these Terms. All Material is provided to you as is. Modification or use of the Material or other content on libertyelectro.com for any purpose not permitted by these Terms may be a violation of the IP Rights therein and is prohibited.

You may access and display Material and all other content from the site for non-commercial, personal, entertainment use on a single computer or device only and may not otherwise copy, reproduce, republish, upload, post, transmit, distribute or use it in any way unless specifically authorized by Liberty Electro LLC. If Liberty Electro does authorize you to copy any Material or any part of the site, that authorization is subject to your reproducing, keeping intact, and not altering, removing, modifying, or suppressing, all copyright and other proprietary notices. Using any Material on any other website or networked computer environment is prohibited. Decompiling, reverse engineering, disassembling, or otherwise reducing the code used in any software on the site into a readable form in order to examine the construction of such software and/or to copy or create other products based (in whole, or in part) on such software, is prohibited.

You understand that, when using the site, you will be exposed to Material from a variety of sources, and that Liberty Electro LLC is not responsible for the accuracy, timeliness, usefulness, or intellectual property rights of or relating to such Material. You further understand and acknowledge that you may be exposed to Material that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you had, have, or may have against Liberty Electro LLC with respect thereto.

We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Liberty Electro LLC will not and does not accept responsibility for information posted in the Comments.

If Liberty Electro receives notice that any posting is not in keeping with these Terms or the intended use of the Comments, we may remove that post and/or any other related posts.

We reserve the right to remove any comment, comments, or posts at any time in our sole discretion.
